Abstract: Norman L. Underwood is a retired senior partner at Troutman Pepper, LLC who previously served as a speechwriter for Gov. Carl Sanders and Senator Sam Nunn, Executive Secretary for Gov. George Busbee, a judge on the Georgia Court of Appeals, and chair of the Georgia Judicial Nominating Committee. Historical Note

Norman L. Underwood is a retired partner at Troutman Pepper (formerly Troutman Sanders) and an Emeritus Member of the Richard B. Russell Foundation Board of Trustees. He began his career at the firm as a speechwriter for former-Georgia Governor Carl Sanders before becoming a partner in 1973. He volunteered as a speechwriter and legal expert for Sam Nunn's 1972 campaign for US Senate. He later managed George Busbee's campaign for governor and served as Busbee's Executive Secretary (Chief of Staff) until 1979, when he was appointed to the Georgia Court of Appeals.

He ran unsuccessfully for Public Service Commissioner in 1972, then for the US Senate in 1980 and for Governor of Georgia in 1982. Under Governor Zell Miller, Underwood worked to create, then chaired, the Georgia Judicial Nominating Commission. AFter his service on the commission, Underwood returned to the practice of law, working as senior partner at Troutman Saners until his retirement.

Upon graduation, he was hired by Carl Sanders' new law firm, Troutman Sanders, LLP, becoming a partner in the firm in 1973. He managed George Busbee's campaign for governor, and Underwood left his law practice to become Busbee's executive secretary in 1975. He was appointed as a judge to the Georgia Court of Appeals in 1979. He resigned at the end of the year in order to run for U.S. Senate. The attempt was unsuccessful, as was his 1982 run for governor. He remained involved with Senator Zell Miller, who appointed him his chairman of the Judicial Selection Commission. He no longer sought public office, but returned to the law firm Troutman Sanders LLP, where he became a senior counsel. Underwood has served as a trustee of the Richard B. Russell Foundation.

This collection includes speeches and speech drafts, correspondence, biographical information, campaign press releases, and other documents related to Norman Underwood's career as a speechwriter for former-Governor Carl Sanders, Executive Secretary (Chief of Staff) for Governor George Busbee, and chair of the Georgia Judicial Nominating Commission. It also contains records of his campaigns for US Senate, Public Service Commissioner, and Governor of Georgia, as well as his career as a partner at the Troutman Sanders lawfirm.

Early speeches written for Governor Sanders, 1962-1971

Note from donor: "Early in 1967 Georgia Governor Carl Sanders completed his term in office. At that time Georgia governors could not seek reelection, and he therefore opened a small law office in Atlanta. I was one of two young lawyers he hired to work in this office with him. I reported for my first day of law practice in early April of 1967. I was assigned to work on a litigation matter involving our client Pet Milk Company. Two weeks after I started working with Governor Sanders, he told me he had agreed to make LAW DAY speech about two weeks later and he lamented that in the previous four years he had come to rely on two speech writers who worked for him in the Governor's Office but were not available to him as a private citizen. He asked me if I would like to try my hand at drafting a speech for the LAW DAY audience. I explained that I had no speech writing experience or training, but I would be glad to undertake to put together a draft that I hoped would be somewhat helpful to him. I read a number of speeches he had delivered while he was governor, and I tried to imitate the cadence and pattern of those speeches in putting together a draft."

Note from donor: "This notebook is a compilation of the major campaign speeches of Carl Sanders in the 1970 gubernatorial campaign. Most of the campaign speeches were drafted by me, but especially in the later stages of the campaign two other members of the campaign staff, Robert Coram and Remer Tyson, who were accomplished and experienced newspaper reporters, drafted some of the speeches. One of the items in the notebook is a transcription of a 30 minute television commercial in which Sanders talked without questions or interruption and explained in his own words what he regarded as principal issues in the campaign and his positions on those issues. With respect to the written speeches, Sanders usually delivered a substantial portion of the prepared text, but it was his custom to make some introductory comments tailored to the particular occasion and any "last minute" developments that he felt he should acknowledge."

Note from donor: "Items from my volunteer work with then Representative Sam Nunn in his first campaign for United States Senate. Items Related to 1972 election for Georgia Public Service Commission. In the 1972 election for United States Senate, I was not involved in the primary campaigns, but shortly after Sam Nunn's victory in the runoff election to become the Democratic nominee he called me to request that I volunteer as much time as possible working with his campaign staff in his campaign headquarters. He explained that he would be away from the headquarters much of the time campaigning throughout the state. He very much wanted to have a lawyer with some campaign experience working with his young staff on matters that involved some legal analysis which he believed applied to many issues that would develop in the highly competitive campaign with Congressman Fletcher Thompson. I arranged with my law firm to spend about 1/2 of each work day at the Nunn headquarters where I became involved with research for speeches, campaign commercials, press releases, and other daily aspects of the campaign. In the final weeks of the campaign, I found myself spending most full days at the campaign headquarters. Items in this box were those that remain in my files years after the campaign concluded. Also in 1972 a senior lawyer in our firm asked me to write a status report pertaining to the election of public service commissioners that year. A copy of my paper is attached along with some other campaign items pertaining to that election."

Files related to Underwood's work for George Busbee, 1974-2004

Note from donor: "The materials in this box are related to my work for Governor George Busbee. I was a volunteer, but I had what turned out to be a significant role in the Busbee campaign for governor in 1974. I was the principal speech writer for that campaign, and I worked closely with Dorothy Wood in the development of campaign commercials for TV and radio. As the campaign evolved, most decisions involving strategy were closely related to the substance of the campaign speeches and commercials. Therefore, my role also evolved into the main strategist for the campaign. When the campaign ended with a successful outcome, Governor-elect Busbee asked me to fill the position of Chief of Staff (then called Executive Secretary) in the office of Governor. I served in this position the entire first term from 1975 through 1978. Early in 1979 Governor Busbee appointed me to serve on the Georgia Court of Appeals. In selecting papers for this box, I have made no effort to duplicate the extensive set of papers in the Busbee Collection in the Russell Library. That collection includes the working papers and official records of both the first and second terms of Governor Busbee and, of course, is a much more comprehensive collection than this box which is intended to show the nature and range of matters that I worked on with Governor Busbee. The materials in this box are intended to be representative examples of my work in the Busbee campaign and as Chief of Staff in the Governor's office. The speeches included in this box were written by me as were many more in the extensive collection of speeches in the Busbee papers. Those papers also include many additional speeches written by press secretary Duane Riner and other staff in the Press Office. Governor Busbee's speaking style was to use a script for most of his significant speeches, and to provide copies to the press which enhanced both the coverage and the accuracy of press reports on the speeches. On many occasions in his 1974 campaign and other informal occasion while he was Governor, he would deliver "stump" speeches with no notes. He was effective in delivering these speeches and was able to have eye contact with the audience throughout the speech, whereas his use of a script limited that eye contact. When he used a script he would frequently add comments at the beginning or end of the speech referring to the occasion or to people in the audience, and these informal comments added much to his warmth and sincerity as a public speaker. All the speeches I wrote for Governor Busbee were based on our daily communication in which he provided guidance on matters he wanted to mention or emphasize in upcoming speeches."

It was necessary for the Governor to call a special legislative session to amend the state budget. The GA Public Broadcasting Network invited Busbee to make a speech on the statewide network to explain the reasons for the special session. I drafted to speech which is attached. The public responded favorably to the speech and it was a significant factor in forming the Governor's image as a fiscal conservative. NLU."

Note from donor: "Correspondence re Georgia Court of Appeals. Correspondence re 1980 Campaign for US Senate. Correspondence re 1982 Campaign for Governor. This box contains correspondence related to my service on the Georgia Court of Appeals. Copies of court working papers are not included because most of those are retained in the Court's records. Also included are papers related to my candidacy in the Democratic primary for US Senate in 1980 and for Governor in 1982. Also included are a significant number of speeches all of which were written by me. It will be noted that speeches, correspondence and other materials from both the 1980 campaign and the 1982 campaign are somewhat intermingles in these records. This is primarily due to the fact that as a candidate I had a very small staff, and copies of these papers were not always retained in orderly chronological files."

Note from donor: "This box contains materials related to the Underwood for Governor campaign of 1982. These items include press releases, staff memos, schedules and various campaign promotion materials. Also included are some internal records of campaign contributions as well as copies of campaign finance reports made to the state ethics commission. These records and reports illustrate the vast differences in the way most candidates raised campaign funds in the early 1980s as contrasted to the way such funds began to be raised in the following decades. In the 1980s most candidates for public office in Georgia raised much of their campaign money from fairly small contributions form a large number of contributors. In later decades it became the normal practice for practically all candidates to expect to raise the bulk of their campaign funds from large donations from a smaller number of contributors."

The two large binders contain copies of letters from me, as Chair of the JNC, to Governor Miller with our "short list" of names of lawyers recommended by the JNC from which the Governor would make an appointment to fill the judicial vacancy. The names of the person appointed to each vacancy is highlighted in these letters. These binders serve as a comprehensive and complete record of every judicial appointment made by Governor Zell Miller in his administration."

Brooks litigation and Troutman Sanders correspondence, 1982-2002

Note for donor: "General correspondence of NLU. Materials related to a complex legal proceeding known as the Brooks litigation. Press coverage related to the Brooks case and other proceedings in which I was involved public or political issues of significance. I have included some of my correspondence for the first two years in which I had rejoined the Troutman Sanders law firm after an eight year absence in which I worked in the State government and ran for office. A portion of the correspondence reflects that transition back into the private sector. Also included are extensive materials related to the Brooks case involving legal challenges to the manner in which Judges in Georgia were elected or appointed. The work of the Judicial Nominating Commission was central to these challenges. As Chair of the JNC I was heavily involved in the litigation and particularly the ultimate resolution of the case. These documents reflect that involvement."
